Kas tegemist ei ole mitte huvide konflikiga?
KVS paragrahvid kehtivad ametnike kohta.
Mis huvide konflikt see on kui KÜ sama teenust mujalt peaks kallimalt ostma? On vaja võtta sarnaste firmade pakkumisi sama töö tegemiseks ja võrrelda neid. Odavam ja parem võidab, samas kõige odavam ei tarvitse kõige parem olla. KÜ ise peab otsustama mida teeb ja kuidas KÜ-le kasulikum on.

Avastasin et meie KÜ ostab sisse teenust mis kuulub juhatuse esimehele. See on ju keelatud? ja tegemist on huvide konfliktiga? Ma ei leidnud seadust selle kohta. Oskab mind keegi aidata? Ja kas keegi on olnud sellises olukorras, mida teha?
Miks see peaks olema keelatud? Kui keegi oma majast teenust teha ei taha ja KÜ-s kellelegi palka maksta ei taheta et seal palgaarvestusega arvepidamist keerulisemaks teha, ning teised firmad nõuaksid sama teenuse eest rohkem raha kui esimehe oma, siis pole selline tegevus ühegi seadusepügalaga keelatud.

Revidendi ülesandeks on jälgida, kas juhatus tegutseb üldkoosoleku otsuste ja põhikirja kohaselt.
Seesama pakkumiste võtmise kohustus alates teatud teenuse maksumusest võib ka ÜK otsus olla.

Lihtsalt niisama kallimalt mujalt osta pole ju mõistlikum ainult sel põhjusel, et soodsama variandi puhul on tegu juhatuse liikmest teenusepakkujaga.
